Today, Congressman John Moolenaar voted to uphold the Second Amendment rights of law-abiding Americans by voting against two bills proposed by House Democrats.

"I will always defend the Second Amendment rights of law-abiding Americans," said Congressman Moolenaar. "Right now, every commercial gun purchase in America goes through the national background check system, but today's legislation goes too far. It would give the FBI unlimited time to dig into the background of every person who purchases a gun. An unlimited timeframe is an abuse of power against law-abiding Americans and they would have no legal recourse to defend their Constitutional rights."

"I have previously supported legislation to fix the background check system and improve access to mental health services. These were reasonable solutions that did not violate the Constitution and I will always support the right of Michigan residents to bear arms and enjoy Michigan's outdoor heritage."

Earlier in the day, Republicans offered an amendment to H.R. 8 that would require law enforcement be notified if the NICS background check system indicated that an illegal alien was trying to buy a gun. Congressman Moolenaar voted for this amendment, but Democrats voted against it and it was defeated.

H.R. 8 would require a background check for legal gun owners to lend a firearm to neighbor, whether for self-protection or for use while on a hunting trip. Federal law already prohibits the transfer of firearms to anyone who is prohibited from possessing a firearm or across state lines to someone without a firearms license.

H.R. 1446 would eliminate the 3-day window where the FBI must complete a background check. Without this window, the FBI would have no incentive to complete background checks in a timely manner and could delay a sale indefinitely.
