U.S. Senator Lisa Murkowski (R-AK) issued the following statement after the U.S. Supreme Court ruled 6-3 in West Virginia v. Environmental Protection Agency (EPA) that EPA exceeded its authority under the Clean Air Act in issuing the Clean Power Plan.
“This decision returns authority over energy and climate policy to Congress, where it belongs. The court majority has it right in finding that EPA was seeking ‘unprecedented power over American industry’ and needs to be reined in. Climate change is real and we have an obligation to address it but that lies with Congress, not an agency. I am proud to have led or been part of three significant efforts in the past two years alone to address energy and climate – my Energy Act, the phasedown of ultra-warming hydrofluorocarbons, and the infrastructure law – which proves that Congress is more than capable of addressing this very real challenge in a bipartisan and reasonable way.”
In December 2021, Murkowski joined 90 of her congressional colleagues on an amicus brief to the Supreme Court on this case.
