DENVER — Construction CEO Joe O'Dea's U.S. Senate campaign filed a complaint with the Federal Election Commission (FEC) for filing electioneering communications without the required disclaimers and a related civil complaint to hold the parties behind the illegal mailers responsible. Separately, the campaign is sending a letter to multiple district attorneys and the Office of the Attorney General for repeated violations of Colorado law, encouraging the offices to “investigate and punish this misconduct immediately."
These repeated campaign violations by unknown, dark-money actors have the express purpose of meddling in Colorado's Republican primary to deliberately misinform voters days before Election Day. Urgent action is necessary to prevent these unknown actors from sending additional false mailers that do not contain disclosures required by law and do not identify who is responsible for their contents.
“The Democrats are falsely attacking me and supporting Ron Hanks, and we’re going to fight back. We can’t drain the whole swamp, but we’re going to try and drain some of it,” said Joe O'Dea.
“These are egregious and reprehensible violations — the mailers violate black letter campaign finance law. The secret actors behind this misconduct believe the rules don’t apply to them and we’re going to hold them accountable,” added Brent Owen, an O'Dea for Senate counsel.
The complaint reads, in part, “If the Commission does not provide immediate relief to stop these willful violations of federal election law, it may change the outcome of a very important Senate race.”
“The Commission should further seek appropriate sanctions for any and all violations of law uncovered during its investigation, including civil penalties sufficient to deter future violations and an injunction against future violations in addition to any other remedies which are necessary and appropriate to ensure compliance with federal law.”
