Last week, a new report published a list of judges that Ron Johnson voted to confirm despite their refusal to state their support for the landmark Brown v. Board of Education decision, which established that racial segregation in schools was unconstitutional.
Does Ron Johnson Still Support Judges Who Wouldn’t Say if They Support Brown v. Board of Education?
U.S. District Court Judge Wendy Vitter: “I don’t mean to be coy but I think I get into a difficult area when I start commenting on Supreme Court decisions which are correctly decided and which I may disagree with,” [on if she agrees with the outcome of Brown v. Board of Education].
U.S. District Court Judge Greg Guidry: “As a district court judicial nominee, it is inappropriate for me to comment on the correctness vel non of a Supreme Court decision.” [on if he agrees with the outcome of Brown v. Board of Education]
U.S. District Court Judge Jeffery Brown: “It would be inappropriate to opine on whether Brown, or any other decision of the Supreme Court that I would be bound to follow, was correctly decided.” [on if he agrees with the outcome of Brown v. Board of Education]
U.S. Court of Federal Claims Judge Richard Hertling: “I believe, however, that it would be inappropriate for me, as a judicial nominee, to express a view as to whether Brown or any decision of the Supreme Court was correctly decided.” [on if he agrees with the outcome of Brown v. Board of Education]
U.S. Circuit Judge Kenneth Lee: “As a nominee, as I said, what would be an inferior court to the one Supreme Court, I’m not going to purport to undertake to grade the Court’s homework.”
