Washington, D.C. — Rep. Donald M. Payne, Jr. voted for the Women’s Health Protection Act today to make abortion legal and accessible to all women nationwide.  The bill (H.R. 3755) guarantees access to reproductive health care for all Americans, regardless of state laws that might limit it.  In 1973, a woman’s constitutional right to an abortion was established in the U.S. Supreme Court case, Roe v. Wade, and it has been upheld in numerous U.S. Supreme Court cases since then.  However, the Court refused to hear arguments against a recent Texas state law that bans abortion after six weeks.  The Texas law violates women’s constitutional rights because most woman do not know they are pregnant until after six weeks have passed. 

“Women should have to right to determine their own health care choices,” said Rep. Donald M. Payne, Jr.  “What happened in Texas is a direct assault on women’s personal freedoms and the U.S. Constitution.  This bill would protect a woman’s right to safe reproductive health care in Texas and across the country.  We need to pass this bill into law, so that other states do not follow Texas and continue this violation of women’s rights.”     

This bill would establish a federal statutory right for health care providers to give women access to abortion free from unnecessary state bans and restrictions intended to impede or block access.  It guarantees access to such care without fears that states will target abortion with laws that do not address other medical procedures with similar risks.  In addition, it provides this access to all American women regardless of background or location within the United States.  It will take the power to make personal health care decisions out of the hands of state governors and legislatures and put it back in the hands of patients and doctors.
