WASHINGTON, D.C. – Today, Congressman Andy Kim (NJ-03) voted to pass the Right to Contraception Act to guarantee the right to obtain and use birth control, including contraceptive pills, IUDs, and emergency contraception. .
“Using contraception is a personal choice. Whether a couple is deciding to start a family or not, it should never be up to someone else to make that decision. Those choices are personal and they should stay that way,” said Congressman Kim. “When something as simple as the right to use or not use birth control is under attack, Congress has a responsibility to act. I am proud to take this vital step to safeguard a basic freedom afforded to all Americans for their privacy, health, and well-being.”
In a concurring opinion in the Dobbs case, Justice Clarence Thomas explicitly called on the Supreme Court to reconsider its decisions protecting other fundamental rights, including the Griswold decision that established the constitutional right to obtain and use contraceptives.
Congressman Andy Kim also voted to pass the Women’s Health Protection Act to defend women’s reproductive rights and the Ensuring Women’s Right to Reproductive Freedom Act to prevent states from blocking or retaliating against a person traveling across state lines to obtain a lawful abortion. Also this week, Congressman Kim voted to protect marriage equality, another right that Justice Thomas mentioned in his concurring opinion.
