Griffith Statement On Supreme Court Decision In West Virginia V. Epa

ongressman Morgan Griffith (R-VA) issued the following statement after the Supreme Court ruled in West Virginia v. Environmental Protection Agency (EPA) that the EPA went beyond its lawful regulatory authority in the Obama Administration’s Clean Power Plan:

“The Supreme Court today reaffirmed one of the fundamentals of our constitutional structure: the legislature writes the laws. The Obama Administration’s EPA overreached its authority to regulate greenhouse gases under the Clean Air Act. The agency gave itself power that Congress had not given to it, and I applaud the Court for reining in this unconstitutional action. This is not the first time the Court has ruled that the Obama-Biden Administration’s EPA went beyond its authority.”

Background

Griffith has argued that the Clean Power Plan overstepped EPA authority since the Obama Administration first put it forward. Most recently, he signed an amicus brief supporting West Virginia in West Virginia v. EPA.
