RALEIGH: Today, members of law enforcement and judges called on Congressman Ted Budd to take down his heinous campaign ad distorting Cheri Beasley’s record:

“Congressman Budd is so desperate to hold onto power, he’s resorting to ugly, dishonest attacks about Cheri Beasley’s record and we are calling on him to take down his ad. As law enforcement officers and judges who worked with Cheri to uphold the law and keep communities safe, we know the truth: Ted Budd will do anything to help himself – even lie to North Carolinians,” said Superior Court Judge (Ret.) Carl Fox, District Court Judge (Ret.) Pat Devine, Superior Court Judge (Ret.) Don Stephens, Mecklenburg County Sheriff Garry R. McFadden, Cumberland County Sheriff Ennis Wright, Fraternal Order of Police Pitt-Greenville Lodge #69 President Don Hardy, and Former Fayetteville Police Officer Reginald Harvey.

Here are the facts:

Ted Budd Falsely Claimed “Cheri Beasley Struck Down A Bipartisan Law Requiring GPS Tracking For Child Predators”

  • The North Carolina Supreme Court decision State v. Grady did not strike down the state law, but limited the decision’s scope to the specific application of the law.
  • The decision made clear the question of whether the Satellite Based Monitoring (SBM) Law was constitutional was not before the court and the court assumed the law’s constitutionality in the decision.
  • The decision concluded that the state’s SBM program was unconstitutional in its application to individuals in the same category as the defendant, not all individuals in the program.
  • The specific group of people was limited to those who already served their time and were no longer supervised by the state.
    • The North Carolina Supreme Court Decision in State V. Grady: “We Conclude that the state’s SBM program is unconstitutional in its application to all individuals in the same category as defendant—specifically […those] who have completed their prison sentences and are no longer supervised by the state through probation, parole, or post-release supervision. We decline to address the application of SBM beyond this class of individuals.”
Ted Budd Falsely Claimed That “A Serial Child Rapist Set Free,” By A North Carolina Supreme Court Ruling

  • The North Carolina Supreme Court’s ruling was limited to whether the law was applied correctly, and had nothing to do with Torrey Grady’s status as a prisoner.
  • Torrey Grady was in jail through September 2022, more than 3 years after the NC Supreme Court ruled in his case.
Ted Budd Falsely Claimed That With Torrey Grady Out Of Jail It Meant “Where’s He Going? No One Knows.”

  • Grady’s location will be known due to his status as a lifetime registered sex offender.
  • As of September 28, 2022, Grady was a registered sex offender on the North Carolina sex offender registry.

Congressman Budd’s special interest allies Club for Growth previously ran a false ad on this same topic, and the Charlotte Observer pointed out the ad’s outrageous distortions. As a judge, more than 98 percent of her rulings were upheld and the United States Supreme Court agreed with her rulings in every case that came before the Court. Independent reviews of her record as a judge found that she was “independent,” “thorough, fair, and even-handed,” and “fair, impartial and free of political bias.”
