David McKinley for Congress: Supreme Court Should Reject EPA’s Overreach Against American Energy

U.S. Supreme Court hears case led by West Virginia’s Attorney General Morrisey

Washington, D.C. - Congressman David B. McKinley, P.E. (WV-01), who serves as ranking member on the Subcommittee on Environment, on the House Energy and Commerce Committee, released a statement regarding a case, West Virginia v. EPA, challenging the Environmental Protection Agency’s (EPA) regulatory overreach, which was argued today before U.S. Supreme Court.

“West Virginians know better than most the cost of EPA overreach, and I am proud that West Virginia Attorney General Patrick Morrisey is leading the effort in the U.S. Supreme Court to protect our state’s coal and natural gas industry against the Biden Administration and unelected bureaucrats’ continued war on fossil fuels and American energy independence,” said Rep. McKinley.

“The conflict Russia has perpetuated in Ukraine has made it increasingly clear that Energy Security is National Security. We should be focused on expanding energy production in America, instead of throwing up roadblocks that restrict our energy independence. Yet, the Biden Administration is more committed to appeasing far-left radical environmentalist organizations than protecting the livelihoods and jobs for American families,” said Rep. McKinley.

“Today’s case will define America’s energy future and I’m proud to continue the fight to defend our coal miners, their families and communities across West Virginia,” said Rep. McKinley.

The case, West Virginia, et al. v. Environmental Protection Agency, focuses on the Environmental Protection Agency’s authorities under the Clean Air Act. Specifically, the U.S. Supreme Court will determine the scope of EPA’s authorities and whether to restore states’ authority to regulate power sector emissions under Section 111(d) of the Clean Air Act.
